1. Agreement to Terms

By accessing or using Vakteye's compliance scanning platform (“Service”), you agree to be bound by these Terms of Service (“Terms”). If you do not agree to these Terms, do not use the Service. These Terms constitute a legally binding agreement between you and Vakteye AB (“Vakteye,” “we,” “us,” or “our”).

2. Description of Service

Vakteye provides automated compliance scanning services that analyze websites for GDPR compliance, security vulnerabilities, and privacy issues. Our Service includes:

• Automated website scanning and analysis
• Cookie and tracker detection
• Security vulnerability assessment
• Human-verified compliance reports
• Continuous monitoring (subscription plans)

3. Account Registration

To use certain features of the Service, you must create an account. You agree to:

• Provide accurate, current, and complete information
• Maintain the security of your password and account
• Accept responsibility for all activities under your account
• Notify us immediately of any unauthorized use

4. Acceptable Use

You may only scan websites that you own or have explicit authorization to scan. You agree NOT to:

• Scan websites without authorization
• Use the Service for illegal purposes
• Attempt to disrupt or compromise the Service
• Reverse engineer or copy our technology
• Resell or redistribute scan results commercially
• Scan government, military, or critical infrastructure sites
• Use the Service to harass or harm others

5. Subscription and Payment

5.1 Billing

Paid subscriptions are billed in advance on a monthly or annual basis. All fees are non-refundable except as required by law or as explicitly stated in these Terms.

5.2 Price Changes

We may change subscription prices with 30 days notice. Price changes will take effect at the start of your next billing cycle.

5.3 Cancellation

You may cancel your subscription at any time. Cancellation takes effect at the end of your current billing period. No partial refunds are provided.

6. Intellectual Property

The Service and its original content, features, and functionality are owned by Vakteye and are protected by international copyright, trademark, and other intellectual property laws.

You retain ownership of any data you submit to the Service. You grant us a limited license to process this data to provide the Service.

7. Compliance Reports

Our compliance reports are provided for informational purposes and represent our findings at the time of scanning. Reports are:

• Valid for 90 days from generation
• Based on publicly accessible website data
• Human-verified for accuracy
• NOT legal advice or a guarantee of compliance

You should consult with legal counsel for compliance decisions.

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

• The Service is provided “AS IS” without warranties of any kind
• We do not guarantee uninterrupted or error-free service
• We are not liable for indirect, incidental, or consequential damages
• Our total liability is limited to fees paid in the 12 months before the claim

9. Indemnification

You agree to indemnify and hold Vakteye harmless from any claims, damages, or expenses arising from your use of the Service, violation of these Terms, or infringement of any third-party rights.

10. Termination

We may terminate or suspend your account immediately, without prior notice, for:

• Breach of these Terms
• Illegal or unauthorized use of the Service
• Non-payment of fees
• At our sole discretion with reasonable notice

11. Governing Law

These Terms are governed by the laws of Sweden. Any disputes shall be resolved in the courts of Stockholm, Sweden. Notwithstanding this, you retain any mandatory consumer protection rights under the laws of your country of residence.

12. Changes to Terms

We reserve the right to modify these Terms at any time. We will provide notice of material changes by posting the updated Terms on our website. Your continued use of the Service after such changes constitutes acceptance of the new Terms.

13. Severability

If any provision of these Terms is found unenforceable, the remaining provisions will continue in full force and effect.
